These Terms of Service govern your (“you”, “user”, or “member”) access to and use of the website (joinquantify.com), member portal, services, and information (collectively, the “Service”) provided by Quantify Health LLC (“Quantify”, “we”, “our”, or “us”). By using the Service of Quantify, you agree to be bound by these Terms of Service described herein. If you are not eligible to use the Service, or do not agree to these Terms of Service, do not access and use the Service. If Quantify, in its sole discretion, determines that you are not eligible to use the Service, or do not comply with these Terms of Service, Quantify has the right to discontinue your access to and use of the Service.
Use of Our Service
By using the Service of Quantify, you represent and warrant to Quantify that:
- You are at least 18 years of age
- You are physically located in a jurisdiction in which we offer our Service, including, without limitation, when utilizing the Service to receive laboratory tests, collect samples for laboratory tests, send laboratory tests to laboratories in the United States, receive interpretations of laboratory test results from a Quantify health coach via electronic communications, and receive consultations from a Quantify health coach via electronic communications
- Your use of the Service is in compliance with all applicable laws and regulations
- You have not previously had your use of our Service discontinued by Quantify
Our Service
Quantify health coaches facilitate the order and shipment to your address of laboratory tests from CLIA-certified laboratories in the United States, obtain laboratory test results, provide you with an interpretation of those test results that you can choose to use for personal health purposes, and provide you with dietary, supplement, and lifestyle recommendations that you can choose to implement for personal health purposes.
A licensed healthcare practitioner may use the same laboratory tests to diagnose medical conditions, prescribe dietary, supplement, and lifestyle changes, prescribe medication, and provide medical advice to you, but we do not provide these services.
Our Service is not intended to, cannot, and should not be expected to be a substitute for:
- Consultation with a licensed healthcare practitioner
- Medical interpretation of laboratory test results
- Diagnosis of medical conditions
- Treatment of medical conditions
- Prescription of dietary, supplement, and lifestyle changes
- Prescription of medication
- Medical advice
By using the Service of Quantify, you agree to acknowledge and accept that:
- Quantify health coaches are not licensed healthcare practitioners
- Our Service, including, but not limited to, our interpretation of laboratory test results, and dietary, supplement, and lifestyle recommendations, is provided to you for informational purposes only and does not constitute medical advice
- We advise that you consult a licensed healthcare practitioner for medical interpretation of laboratory test results
- We advise that you consult a licensed healthcare practitioner before implementing the dietary, supplement, and lifestyle recommendations that we provide
- We advise that you consult a licensed healthcare practitioner on any matter relating to your health
Medical Emergency Situations
Our Service is not intended for medical emergency situations. In the event of medical emergency, please call 911 or appropriate emergency responders in your jurisdiction.
Exclusion of Warranty
By using the Service of Quantify, you agree to acknowledge and accept that we make no warranty, express or implied, as to:
- The accuracy of the laboratory test results that we receive
- The accuracy of our interpretation of laboratory test results
- The safety of the dietary, supplement, and lifestyle recommendations that we provide
- The effectiveness of the dietary, supplement, and lifestyle recommendations that we provide
- The accuracy of the information that we provide on our website and in electronic communications
All other warranties are excluded to the maximum extent permitted by law.
Exclusion of Liability
By using the Service of Quantify, you agree to acknowledge and accept that we are not responsible or liable, directly or indirectly, for damage or loss caused by or alleged to be caused by:
- Your use of, or reliance on, the laboratory test results that we receive
- Our interpretation of laboratory test results
- Our failure to identify medical conditions
- Your implementation of the dietary, supplement, and lifestyle recommendations that we provide
- The information that we provide on our website and in electronic communications
All other liabilities are excluded to the maximum extent permitted by law.
Electronic Communications
By using the Service of Quantify, you consent to receive electronic communications from Quantify via email, phone, and text, and our member portal.
Payment
Quantify uses Stripe Payments, a payments service provided by Stripe Inc. (“Stripe”), to process payments. By paying for our Service, you agree to be bound by Stripe’s Terms of Service available at stripe.com/legal/ssa.
Privacy Policy
Please see our Privacy Policy for a description of how Quantify collects, uses, discloses, and protects your personal information in connection with the Service. Your agreement to these Terms of Service constitutes your agreement to our Privacy Policy. If you do not agree to our Privacy Policy, do not access and use the Service.
Changes to Terms of Service
Quantify reserves the right, in its sole discretion, to change these Terms of Service. If we change these Terms of Service, we will update the date at the top of this page, and such changes will be effective as of this date. Your use of the Service of Quantify after any such changes constitutes your agreement to the new Terms of Service. If you do not agree to these or future Terms of Service, do not access and use the Service of Quantify.
